Restructuring and Insolvency
We advise companies and institutes on all aspects of insolvency law.
We provide indebted companies with concepts for recapitalization and restructuring, for individual companies or on a group basis, including accounting and financial structures; we advise in cases of liquidation, create and evaluate insolvency plans, negotiate with tax offices and file recapitalization release applications. We provide advice to the management bodies of the indebted company concerning liability claims and acts liable to result in criminal proceedings.
We negotiate with trade unions and works councils/staff councils regarding site closures and mass redundancies; we prepare mass redundancy notices, plan and implement reconciliations of interest and social plans and conduct the relevant wrongful dismissal lawsuits.
We also support creditors when it comes to the enforcement of their claims and develop backup concepts to protect these claims.
Beyond the crisis, we advise insolvency-proof balance sheet restructuring, such as the securitization of claims or the implementation of Contractual Trust Arrangements.
